Indian American CEO underpaid her domestic help and made her sleep beside dogs
Indian American CEO, Himanshu Bhatia co-founded Rose International in 1993 and her hidden crime of domestic ill-treatment comes out in 2016. These 23 years of her life made Rose International a 5000+ employee company with turnover of more than $300 million. Rose international is an IT staffing and recruiting firm. Sheela Ningwal, her domestic help came out with how Bhatia ill treated her in her 2 years of employment.
Himanshu made Ningwal work in multiple homes for 30 months and has acted inhuman to the domestic helper. In some cases Ningwal was made to sleep in the garage along with the dogs. Sometimes Ningwal was locked in the house without food. Bhatia took Ningwals passport so that she could not run away. It looked more like slavery in this democratic world. After 30 months Ningwal was fired because she was caught reading California’s labor laws.
Himanshu gets an approval of 78% in Glass Door and looking at how the company is doing her compensation is not less than a 6 digit figure. But how she paid and treated her domestic help is shocking!
Sheela Ningwal the Domestic Help
Sheela Ningwal worked as a domestic help for Bhatia from July 2012 to December 2014. During this time Nigwal was paid a monthly wage of $400 for 15.5 hours of work per day and 7 days a week. As per the Department of Industrial Relations, minimum wage in state of California is $10 and full time employees can work only 40 hours per week.
Post 8 hours a day or 40+ hours a week, the employee is entitled to get 1.5 times of the minimum wage. If the employee works more than 12 hours he/she is entitled to get 2times of minimum wage for the extra working hours.
As per the below calculations Bhatia got a $6280 worth monthly domestic help at free of cost for 30 months.
|Basic Minimum wage||$10|
|Number of hours a day||15.5|
|Wage per day Week Day||8×10 + 6.5×20 = $210|
|Wage per day Week End||15.5 x 20 = $310|
|A week has 5 weekdays and 2 week ends||210×5+310×2 = $1670|
|Monthly Approximate wage||$6680|
|Monthly Loss to Ningwal||$6280|
The U.S. Labor Secretary Thomas E Perez filed a complaint against Bhatia on Aug. 22 in the U.S. District Court for the Central District of California. Ningwal is entitled to get $188,400 from Bhatia.
Employer paying less than minimum wage
Employee can either file a wage claim with the Division of Labor Standards Enforcement (the Labor Commissioner’s Office), or file a lawsuit in court against your employer to recover the lost wages.
Himanshu Bhatia might be a big name in IT recruiting industry but ill treating and under paying her domestic help (who is also her employee) is unacceptable. I too worked in the USA and the reason why there is something known as a minimum wage is to create dignity of labour. This brutal step of Bhatia will effect Rose International’s name. As they say, bad news spreads faster than good deeds.
I hope Ningwal gets her compensation and respect!
